Terms of Service

1. Agreement to Terms

By accessing or using My Church Brain ("Service"), you agree to be bound by these Terms of Service ("Terms"). These Terms apply to all visitors, users, and others who access or use the Service. If you disagree with any part of these Terms, you may not access the Service.

2. Description of Service

My Church Brain provides AI-powered content generation tools designed to help churches create on-brand communications. Our ChurchBrain AI™ technology learns your church's unique voice and generates content including social media posts, emails, bulletins, and other communications materials.

3. Account Registration

To use certain features of the Service, you must register for an account. When you register, you agree to:

  • Provide accurate, current, and complete information
  • Maintain and update your information to keep it accurate
  • Maintain the security and confidentiality of your login credentials
  • Accept responsibility for all activities that occur under your account
  • Notify us immediately of any unauthorized use of your account

4. Subscription and Payment

Some features of the Service require a paid subscription. By selecting a paid subscription, you agree to pay the subscription fees indicated for that service.

  • Subscription fees are billed in advance on a monthly or annual basis, depending on the plan selected
  • Subscriptions automatically renew unless cancelled before the renewal date
  • Refunds are generally not provided for partial subscription periods
  • We reserve the right to change subscription fees with 30 days notice

5. Acceptable Use

You agree to use the Service only for lawful purposes and in accordance with these Terms. You agree not to:

  • Use the Service in any way that violates any applicable federal, state, local, or international law or regulation
  • Upload or transmit any content that is unlawful, harmful, threatening, abusive, harassing, defamatory, or otherwise objectionable
  • Impersonate or attempt to impersonate another person or entity
  • Interfere with or disrupt the Service or servers connected to the Service
  • Attempt to gain unauthorized access to any portion of the Service or any other systems or networks
  • Use any automated means to access the Service or collect information from it
  • Resell or redistribute the Service without our prior written consent

6. Your Content and Data

You retain ownership of any content you upload to the Service, including sermons, newsletters, style guides, and other materials ("Your Content"). By uploading Your Content, you grant us a limited license to:

  • Process and analyze Your Content to train your church's unique AI voice model
  • Generate content based on Your Content as directed by you
  • Store Your Content securely to provide the Service

We will not use Your Content to train general AI models or share Your Content with third parties except as necessary to provide the Service or as required by law.

7. Generated Content

Content generated by ChurchBrain AI™ based on your inputs and training materials ("Generated Content") is owned by you. You are solely responsible for reviewing, editing, and approving all Generated Content before publication. We make no warranties regarding the accuracy, appropriateness, or theological correctness of Generated Content.

8. Intellectual Property

The Service and its original content (excluding Your Content and Generated Content), features, and functionality are and will remain the exclusive property of My Church Brain and its licensors. The Service is protected by copyright, trademark, and other laws. Our trademarks, including "My Church Brain" and "ChurchBrain AI," may not be used in connection with any product or service without our prior written consent.

9. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination:

  • Your right to use the Service will immediately cease
  • You may request an export of Your Content within 30 days of termination
  • We may delete Your Content after the 30-day export period

10. Disclaimer of Warranties

The Service is provided on an "AS IS" and "AS AVAILABLE" basis, without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, non-infringement, or course of performance. We do not warrant that the Service will function uninterrupted, secure, or available at any particular time or location, or that any defects or errors will be corrected.

11. Limitation of Liability

To the maximum extent permitted by applicable law, in no event shall My Church Brain, its affiliates, directors, employees, or agents be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your access to or use of or inability to access or use the Service. Our total liability shall not exceed the amount you paid us in the twelve months prior to the claim.

12. Indemnification

You agree to defend, indemnify, and hold harmless My Church Brain and its affiliates, licensors, and service providers from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees arising out of or relating to your violation of these Terms or your use of the Service.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved in the state or federal courts located in Delaware.

14. Changes to Terms

We reserve the right to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion. By continuing to access or use the Service after revisions become effective, you agree to be bound by the revised Terms.
